| dc.description.abstract | Zákon č. 89/2012 Sb., občanský zákoník, zavedl do našeho právního řádu relativně komplexnější úpravu institutu nezbytné cesty než tomu bylo za účinnosti starého občanského zákoníku. I přes tuto skutečnost však předmětná ustanovení obsahují celou řadu pojmů a nejasností, které je zapotřebí vykládat v kontextu s aktuální judikaturou. Vzhledem k tomu, že v posledních letech zažívá Česká republika tzv. realitní boom, v rámci kterého dochází k prodeji řady nemovitých věcí bez právně ošetřené příjezdové cesty, nabývá tento institut na významu. Tyto případy s sebou přináší nové a jedinečné skutkové okolnosti, na které musí reagovat právě judikatura, podle které se lze následně lépe orientovat v dané problematice. | cs |
| dc.description.abstract-translated | Law. nr. 89/2012 Coll., civil code, has incorporated to our legal order more complex legislation concerning the institute necessary path then it used to be under the affection of the old civil code. Despite this fact some provisions of the law still contains some concepts, which needs to be interpreted in respect with the current case law. Due to the fact, that Czech rep. is going in past few years though a reality boom and due to the fact, that some properties are being sould with out legal path, we may consider the institute of necessary path as important. The case law must respond to these circumstances, brought by a lot of real estate transactions. In accordance to this fact, we may use the case law for better interpretation of the institute necessary path. | en |
