dc.description.abstractDne 1. 4. 2020 nabyla účinnosti dlouho očekáváná novela zákona o majetku České republiky a jejím vystupování v právních vztazích. Cílem této novely bylo mj. odstranit Nejvyšším soudem judikaturně dovozovaný zákaz vymáhat náhradu škody po zaměstnancích organizační složky státu v případě, kdy v důsledku jejich zaviněného porušení právních povinností byla jejich zaměstnavateli – příslušné organizační složcestátu – udělena sankce jinou organizační složkou státu. Přinesla však přijatá novela skutečně zamyšlené účinky? Zodpovězením položené otázky se autoři zabývají v předkládaném článku.cs
dc.description.abstract-translatedOn 1 April 2020, the long-awaited amendment to the Act on the Property of the Czech Republic and its Representation in Legal Relations came into force. The aim of this amendment was, among other things, to remove the prohibition, which had been introduced by the Supreme Court in case law, to recover damages from employees of an organizational unit of the state in the event that, as a result of their culpable breach of legal obligations, their employer - the relevant organizational unit - was sanctioned by another organizational unit of the state. However, has the adopted amendment really had the intended effects? The authors address the question in the present article.en
