dc.description.abstractDiplomová práce se zabývá analýzou vybraných aspektů problematiky pracovněprávních vztahů s cizím prvkem. Závěrem práce je zhodnocení, zda rozebírané právní normy reflektují jednu ze základních zásad pracovního práva, tj. zásadu ochrany zaměstnance jako slabší smluvní strany. V úvodu jsou vymezeny obecné pojmy, které se k tématu vážou, tj. cizí prvek, cizí prvek v pracovněprávních vztazích a mezinárodní právo soukromé. Následuje pojednání o materii určení rozhodného práva a pravomoci soudu. Zvláštní pozornost je věnována rozboru pramenům evropského mezinárodního práva soukromého, tj. nařízení Řím I a nařízení Brusel I bis. Rozebrána je taktéž dvoustranná mezinárodní smlouva mezi ČR a Ukrajinou, jakož i vnitrostátní úprava. Dále je výklad zaměřen na otázky týkající se zaměstnávání cizinců. Vyložen je pojem cizinec a zmíněn odlišný přístup cizinců na pracovní trh. Práce je zakončena problematikou vysílání pracovníků. Je charakterizována směrnice, která byla implementována do zákoníku práce.cs
dc.description.abstract-translatedThe diploma thesis deals with the analysis of selected aspects of employment relations with foreign element. The thesis concludes with an assessment of whether the legal norms analysed reflect one of the basic principles of labour law, i.e. the principle of protection of the employee as the weaker party to the contract. In the introduction, the general concepts related to the topic are defined, i.e. foreign element, foreign element in labour relations and private international law. This is followed by a discussion on the matter of determining the applicable law and the jurisdiction of the court. Particular attention is paid to an analysis of the sources of European private international law, i.e. the Rome I and Brussels I bis Regulations. The bilateral international treaty between the Czech Republic and Ukraine is also analysed, as well as the national legislation. Furthermore, the interpretation focuses on issues related to the employment of foreigners. The concept of a foreigner is explained and the different access of foreigners to the czech labour market is mentioned. The thesis concludes with the issue of posting of workers. The directive that has been implemented in the Czech Labour Code is characterised.en
