| dc.description.abstract | Podílové spoluvlastnictví představuje významný občanskoprávní institut, který upravuje situace, kdy vlastnická práva k jedné věci náleží současně více osobám. Tato práce si klade za cíl komplexně analyzovat spoluvlastnictví podle zákona č. 89/2012 Sb., občanský zákoník. Začíná historickým vývojem a formováním pojmu od římského práva přes ABGB až po moderní českou legislativu. Práce pak podrobně zkoumá definici, předmět, vznik, práva a povinnosti spoluvlastníků a právní vztahy vznikající v rámci spoluvlastnictví. Zvláštní pozornost je věnována mechanismům ukončení a vypořádání - včetně rozdělení, přidělení majetku, prodeje, oddělení a odložení ukončení - a stanovení přiměřené kompenzace ve vztahu k tržní hodnotě. Analýza ukazuje, že současný právní rámec poskytuje dostatečné nástroje pro řešení sporů mezi spoluvlastníky a zároveň zdůrazňuje stěžejní roli judikatury při výkladu zákonných ustanovení. | cs |
| dc.description.abstract-translated | The proportionate co-ownership represents a significant institute of civil law that regulates situations where ownership rights to one thing belong simultaneously to multiple persons. This thesis aims to comprehensively analyze co-ownership under Act No. 89/2012 Coll., the Civil Code. It begins with the historical development and formation of the concept from Roman law through ABGB to modern Czech legislation. The work then examines in detail the definition, subject matter, origin, rights and obligations of co-owners, and legal relationships arising within co-ownership. Special attention is paid to termination and settlement mechanisms including partition, allocation of property, sale, separation, and postponement of termination and to the determination of adequate compensation in relation to market value. The analysis demonstrates that the current legal framework provides sufficient tools for resolving disputes among co-owners while highlighting the pivotal role of case law in interpreting statutory provisions. | en |
