| dc.description.abstract | Předložená práce se zabývá staronovým institutem, který přináší současný občanský zákoník - dědickou smlouvou. V první číslované kapitole je řešena geneze tohoto pořízení pro případ smrti. V dalších čtyřech kapitolách je dědická smlouva představena v kontrastu dědického práva a následně i celého občanského práva. Autor se snaží osvětlit některé problematické pasáže pomocí odborné literatury za použití komparativní metody. Poslední kapitola přibližuje některé aspekty, které přináší praxe po uzavření dědické smlouvy. Těmi jsou zápis do příslušné evidence Notářské komory ČR a způsob vyúčtování odměny notáře. | cs |
| dc.description.abstract-translated | The presented thesis deals with the old-new institute, which brings the current Civil Code - the inheritance contract. The first numbered chapter deals with the origin of this disposition mortis causa. In the next four chapters the inheritance contract is presented in contrast to inheritance law and consequently the whole civil law. The author tries to explain some problematic passages by means of professional literature using a comparative method. The last chapter describes some aspects of practice after the inheritance contract is concluded. Those are entry in the relevant register of the Notarial Chamber of the Czech Republic and the method of billing of the notary's fee. | en |
