| dc.description.abstract | Diplomová práce se zabývá trestným činem maření spravedlnosti, zavedeným do českého právního řádu v roce 2019. V první části práce jsou přiblíženy historické souvislosti, kde je popsán právní stav a jeho judikaturní vývoj ještě před přijetím uvedeného trestného činu a dále jsou blíže uvedeny důvody legislativní změny. V druhé části je představena skutková podstata trestného činu maření spravedlnosti a jeho pojmové znaky. Následuje třetí část, kde jsou přiblíženy reakce odborné veřejnosti a právní praxe na přijetí této nové skutkové podstaty. V další části je řešena otázka týkající se maření spravedlnosti v kontradikci s právem na obhajobu. Navazuje poslední část týkající se porovnání této české právní úpravy s úpravou zahraniční. | cs |
| dc.description.abstract-translated | The diploma thesis deals with the criminal offense of obstruction of justice, introduced into the Czech legal system in 2019. The first part of the thesis describes the historical context, where the legal situation and its case law development are described even before the adoption of the said criminal offense, and further on are detailed the reasons for the legislative change. The second part presents the factual nature of the crime of obstruction of justice and its conceptual features. Then follows the third part, where the reactions of the professional public and legal practice to the adoption of this new factual basis of the said crime are described. The next part deals with the question of obstruction of justice in contradiction with the right to legal defence. Then follows the last part regarding the comparison of this Czech legislation with foreign legislation. | en |
