dc.description.abstractRigorózní práce je zaměřena na flexibilní formy výkonu práce. V úvodu práce jsou vymezeny vybrané základní zásady pracovního práva, je popsán pojem flexicurity a jeho dvě složky - flexibilita a ochrana a uplatňování flexicurity v pracovním právu. Dále je uvedeno vymezení a dělení flexibilních forem výkonu práce. Jádrem práce je pojednání o flexibilních formách pracovní doby a flexibilních formách zaměstnání, v tomto kontextu je vymezena i pracovní doba a doba odpočinku. Jsou popsány flexibilní formy výkonu práce upravené v zákoníku práce i ty zákoníkem práce neupravené, zejm. kratší pracovní doba, konto pracovní doby, práce přesčas, pracovní poměr na dobu určitou, dohody o pracích konaných mimo pracovní poměr, agenturní zaměstnávání, práce mimo pracoviště zaměstnavatele, sdílení pracovního místa aj. Další kapitoly se věnují popisu flexibilních forem výkonu práce v EU, vybraným rozhodnutím českých soudů a rozhodnutí SDEU souvisejících s flexibilními formami výkonu práce a komparaci se zahraniční právní úpravou. Na závěr je zařazeno pojednání o dopadu onemocnění COVID-19 na výkon závislé práce.cs
dc.description.abstract-translatedThe thesis is focused on the flexible working arrangements. In particular, it describes selected principles of labour law, the term flexicurity and its two components, namely flexibility and security and using flexicurity in labour law. The thesis deals with the term of flexible working arrangements and its classification. The main part represents description of the flexible working arrangements, working time and rest period. Furthermore, flexible working arrangements provided for the Labour Code and the others, particularly shorter working hours, working time account, working overtime, fixed-term job, work agreements outside employment, agency employment, home working, job sharing and others are described. The next chapters deal with the flexible working arrangements in the EU, selected decisions of the Court of Justice of the European Union and the Czech courts related with the flexible working arrangements and comparison of the Czech legislation with the foreign legislation. The effects of the pandemic of COVID-19 on the work performance are discussed in the last part of the thesis.en
