| dc.description.abstract | Tato diplomová práce se věnuje české právní úpravě alternativních trestů. Hlavním cílem diplomové práce je stanovit, zda je právní úprava alternativních trestů dostatečná a účinná. Zároveň je cílem i přiblížit širší veřejnosti problematiku alternativních trestů. Práce je dělena na osm kapitol, přičemž první kapitola pojednává obecně o pojmu a účelu trestu, restorativní justici a probační a mediační službě. Dále je rozebrán pojem alternativního trestu. Další tři kapitoly se věnují právní analýze trestu domácího vězení, trestu obecně prospěšných prací a peněžitému trestu. Šestá kapitola se věnuje statistickému vývoji ukládání jednotlivých trestů a vývoji recidivy. V sedmé kapitole je provedena komparace právní úpravy s Francií. Poslední kapitola obsahuje zhodnocení právní úpravy alternativních trestů a návrhy de lege ferenda. V závěrečné části je shrnutí klíčových oblastí problematiky alternativních trestů a vyhodnocení cílů diplomové práce. | cs |
| dc.description.abstract-translated | This diploma thesis is devoted to the Czech legal regulation of alternative punishments. The main objective of the thesis is to determine whether the legal regulation of alternative punishments is sufficient and effective. At the same time, the purpose is to bring the issue of alternative punishments closer to the wider public. The thesis is divided into eight chapters, while the first chapter deals generally with the concept and purpose of punishment, restorative justice and probation and mediation service. Next, the concept of alternative punishment is analyzed. The next three chapters are devoted to the legal analysis of house arrest, community service and financial penalty. The sixth chapter is devoted to the statistical development of the imposition of individual punishments and the development of recidivism. In the seventh chapter, a comparison of the legislation with France is made. The last chapter contains an evaluation of the legal regulation of alternative punishments and proposals de lege ferenda. The final part contains a summary of the key areas of the issue of alternative punishments and an evaluation of the objectives of the thesis. | en |
