Abstract

Tento článek se zabývá hmotněprávními podmínkami účasti osob nezletilých a osob omezeně svéprávných ve volených orgánech právnických osob, jejich popisu a dílčí analýze. Článek dále obsahuje zhodnocení podmínek pro účast osob nezletilých a osob omezeně svéprávných ve volených orgánech právnických osob před novelou zákona o obchodních korporacích, účinnou od 1. 7. 2023, a po ní. V článku je obsažena i úvaha týkající se účastni těchto osob ve volených orgánech obchodních korporací v návaznosti na tuto novelu.512 / 5 000This article deals with the substantive conditions for the participation of minors and persons with limited legal capacity in the elected bodies of legal entities, their description and partial analysis. The article also contains an assessment of the conditions for the participation of minors and persons with limited legal capacity in the elected bodies of legal entities before and after the amendment to the Act on Business Corporations, effective from 1 July 2023. The article also contains a consideration regarding the participation of these persons in the elected bodies of business corporations in connection with this amendment.
