dc.description.abstractDiplomová práce se zabývá adekvátností trestání domácího násilí v České republice. Zda tresty odpovídají spáchanému činu a jeho následkům. Problematika bude prezentována zejména z pohledu, jestli je domácí násilí subsumováno pod správné trestné činy a jestli ukládané trestní sazby reflektují závažnost tohoto trestného činu. Práce je členěna do pěti kapitol. První kapitola se věnuje konkrétně pojmu domácího násilí, který v České republice není legálně definován. Druhá kapitola popisuje a analyzuje hmotněprávní úpravu domácího násilí. Třetí kapitola stručně zmiňuje ochranu obětí domácího násilí. Čtvrtá kapitola se věnuje trestání domácího násilí. Na základě vyhodnocení čtvrté kapitoly, se pátá kapitola zabývá úvahy de lege ferenda.cs
dc.description.abstract-translatedThis diploma thesis deals with the adequacy of punishment of domestic violence in the Czech Republic. Whether the penalties correspond to the committed act and its consequences. The issue will be presented mainly from the point of view of whether domestic violence is subsumed under the right crimes and whether the imposed penalty rates reflect the seriousness of this crime. The thesis is divided into five chapters. The first chapter deals specifically with the concept of domestic violence, which is not legally defined in the Czech Republic. The second chapter describes and analyzes the substantive law of domestic violence. The third chapter briefly mentions the protection of victims of domestic violence. The fourth chapter deals with the punishment of domestic violence. Based on the evaluation of the fourth chapter, the fifth chapter deals with de lege ferenda considerations.en
