dc.description.abstractTato diplomová práce je věnována současnému českému soudnictví nad mládeží. V úvodní části rekapituluje základní pojmy a zásady řízení jak s dětmi, tak s mladistvými. V práci jsou specifikovány odlišnosti soudnictví nad mládeží od soudnictví obecného, dále je do hloubky rozebrána Probační a mediační služba, její působení na průběh řízení i na pachatele samotného. Zvláštní místo má v práci elektronický monitoring, kterému je věnována jedna vlastní podkapitola, a několik dalších v porovnávání české právní úpravy se zahraniční, co se opatření nahrazujících vazbu týká. Práce je zakončena dvěma úvahami de lege ferenda, celkovým zamyšlením nad současným soudnictvím nad mládeží a anglicky psaným resumé.cs
dc.description.abstract-translatedThis paper observes Czech criminal juvenile law, especially the trial procedure. In this work, I focused on differentiation of juvenile and adult criminal law, specifying the differences throughout the entire work. Introductory part summarizes basic terms and legal principles used within juvenile court procedure such as restorative justice or specialized juvenile court. Mainly I focused on Czech Probation and Mediation service and its' foreign alternatives, and on juvenile custody and possible alternatives to it. The idea of this work was to come up with a summary of the alternatives and bring in a new view with the coming of electronic monitoring system in near future while using the praxis and knowledge of countries which already use this system, or systems similar to it. I also wrote two essays de lege ferenda. The first essay is considering the ethics of electronic monitoring and it also ponders about benefits for both parties, the offender as well as law enforcement subjects. I promote the idea of electronic monitoring being better for juvenile suspects/offenders rather than keeping them in any penitentiary facility. I have also dealt with three probable ways of realization of the EM project. Second essay deals with discussion of lowering Czech criminal responsibility age restriction, which is currently at 15 years of age. I have come up with a new approach, which I believe will make the readers think about parallel lower age restriction for serious crime offenders, as I believe that current approach to serious offenders has been too soft on them, and didn't have enough repressive effect, however, I still think that restorative justice is a set of good principles to follow, nevertheless, it lacks repressive means to sanction the most dangerous juvenile criminals.en
