dc.description.abstractTato diplomová práce se zabývá institutem odposlechu a záznamu telekomunikačního provozu podle českého právního řádu. Představuje odposlech jako nástroj orgánů činných v trestním řízení, který používají k objasňování a dokazování páchané trestné činnosti. Zabývá se oběma instituty, které trestní řád subsumuje pod společný název "odposlech a záznam telekomunikačního provozu", a to jednak odposlech podle § 88 trestního řádu, jednak zjišťování údajů o uskutečněném telekomunikačním provozu podle § 88a trestního řádu. Pokouší se o rozbor aktuálně platné právní úpravy a rozvádí její některé problematické aspekty.cs
dc.description.abstract-translatedThis diploma thesis deals with the institution of wiretapping and recording of telecommuniacation traffic according to Czech law. Diploma thesis presents interception like a tool for law enforcement to detect and prove criminal offenses. The interpretation is divided into two different institutes, which are defined by the Criminal Procedure Code. These are, on the one hand, the interception and recording of telecommunications traffic pursuant to § 88 of the Code of Criminal Procedure, and the identification of data on the already executed telecommunications operation pursuant to § 88a of the Criminal Procedure Code. The diploma thesis attempts to introduce the applicable legal legislation for the wiretapping and introduce some of the problematic aspects of wiretapping.en
