| dc.description.abstract | Hlavním cílem této práce je uceleně popsat novou právní úpravu institutů povinného dílu, nepominutelného dědice a vydědění a upozornit na nejdůležitější změny, které po rekodifikaci nastaly. Práce je rozdělena do tří hlavních kapitol: Nepominutelný dědic, Povinný díl, Vydědění. První kapitola se zabývá pojmem nepominutelného dědice a definováním toho, kdo je nepominutelným dědicem. Druhá kapitola se zaměřuje na povinný díl, konkrétně na to, jakou může mít povinný díl podobu a jak jej lze vypořádat dle aktuální právní úpravy. Poslední a také nejrozsáhlejší kapitola se zabývá vyděděním nepominutelného dědice a popisem zákonných důvodů vydědění a také sporu o platnost vydědění. | cs |
| dc.description.abstract-translated | The main aim of this thesis is to describe coherently the new forced share, forced heir and disinheritance legislation and point out the main and most important changes due to a new Civil Code. The thesis is divided into three main chapters: Forced heir, Forced share and Disinheritance. The first chapter deals with the notion of the forced heir. Defining who the forced heir is. The second chapter focuses on the forced share, namely on its forms and settlement according to the current legislation. The last and also the most extensive chapter deals with the disinheritance of the forced heir, describing all legal reasons for disinheritance and the disinheritance disputes. | en |
