Důsledky nelegální práce v oblasti ochrany zdraví cizinců

Abstract

Článek se zabývá výkonem nelegální práce cizinců a zaměřuje se na preventivní a následnou ochranu zdraví při práci. Při výkonu nelegální práce může dojít k zásadnímu narušení prvků ochrany, což přináší cizincům řadu negativních důsledků. Cílem článku je na tyto důsledky upozornit. Článek se podrobně zabývá příčinami nelegální práce a její právní úpravou v právním řádu České republiky. Zejména je poukázáno na sníženou právní ochranu postavení zaměstnance jako slabší smluvní strany v souvislosti s absencí preventivní ochrany zdraví. Článek se rovněž zabývá pracovními úrazy a jejich nejzávažnějšími důsledky pro cizince.

The article deals with the performance of illegal work by foreigners and focuses on preventive and follow-up protection of health at work. During the performance of illegal work, the elements of protection can be fundamentally affected, which brings a number of negative consequences for foreigners. The article aims to highlight these consequences. The article deals in detail with the causes of illegal work and its legal regulation in the legal system of the Czech Republic. In particular, the reduced legal protection of the employee's position as a weaker party to the contract is highlighted in the context of the lack of preventive health protection. The article also discusses work-related accidents and the most serious consequences for foreigners.
