dc.description.abstractPro účely své bakalářské práce jsem si vybrala téma Porovnání exekuce správní a soudní. Téma exekuce je v České republice velmi aktuální, neboť exekucí je postižena nemalá skupina jak fyzických tak i právnických osob. V českém právním řádu rozlišujeme exekuce správní a soudní. U soudního typu exekucí existuje tzv. dvoukolejnost soudního výkonu rozhodnutí, což znamená, že exekuci je možno vykonat buďto prostřednictvím soudu anebo prostřednictvím soudního exekutora, a to dle podmínek stanovených v zákoně. Jde-li o soudní výkon rozhodnutí je příslušný zákon č. 99/1963 Sb. občanský soudní řád a v případě exekuce provedené soudními exekutory pak zákon č. 120/2001 Sb. exekuční řád. U správní exekuce je základním pramenem zákon č. 500/2004 Sb. správní řád. Jakousi "podskupinou" správní exekuce je exekuce daňová vykonávaná dle zákona č. 280/2009 Sb. daňový řád.cs
dc.description.abstract-translatedFor the purposes of my thesis I chose the topic of comparison of administrative and judicial distraint. The theme of distraint in the Czech Republic is very topical because of foreclosures is affected by both a group of physical and legal persons. In the Czech legal order there are administrative and judicial execution. At the Court of execution, there is a so-called type disunity of the enforcement of the decision, which means that it is possible to perform the execution, either through the Court or by a court bailiff, and according to the conditions laid down in the law. As regards the judicial enforcement of decisions is the Act No 99/1963 Coll., civil procedure, and in the case of distraints carried out by the judicial executors then Act No 120/2001 Coll. the enforcement order. On the administrative execution is the basic source of Act No. 500/2004 Coll., the administrative code. A "subset" of the administrative distraint is execution tax carried out pursuant to Act No. 280/2009 Coll. tax regulations.en
