dc.description.abstractTato diplomová práce se věnuje roli státního zástupce v trestním řízení. Hlavním cílem práce je čtenáři přiblížit institut státního zastupitelství a jeho důležitost v trestním řízení. Práce je členěna do 7 hlavních kapitol a k tomu obsahuje úvod, závěr a cizojazyčné resumé. První kapitola se věnuje pojmu a historii veřejné žaloby. Druhá kapitola je věnována rozdílnému pojetí a organizaci státního zastupitelství v sousedních státech. Ve třetí kapitole se pojednává především o organizaci a právní úpravě státního zastupitelství v České republice. Následující, čtvrtá kapitola se zaměřuje na důležitost postavení státního zástupce v přípravném trestním řízení Pátá kapitola pojednává o obžalobě a na ni navazuje šestá kapitola věnovaná roli státního zástupce v řízení před soudem. Poslední, sedmá kapitola zmiňuje základní charakteristiky odklonů v trestním řízení.cs
dc.description.abstract-translatedThis thesis focuses on the role of the public prosecutor in criminal proceedings. The main goal of the thesis is to familiarize the reader with the institution of the public prosecution and its importance in criminal proceedings. The thesis is divided into seven main chapters and also contains an introduction, conclusion and foreign language summary. The first chapter addresses the concept and history of public prosecution. The second chapter is dedicated to the different approaches and organization of public prosecution in neighbouring countries. The third chapter primarily discusses the organization and legal framework of the public prosecution in the Czech Republic. The following fourth chapter focuses on the significance of the position of the public prosecutor in the pre-trial criminal proceedings. The fifth chapter deals with the indictment, followed by the sixth chapter, which is dedicated to the role of the public prosecutor in the court proceedings. The final, seventh chapter mentions the basic characteristics of diversion in criminal proceedings.en
