| dc.description.abstract | Práce s názvem "Právní otázky zaměstnávání cizinců" si klade za cíl přiblížit problematiku zaměstnávání cizinců na našem území. První kapitola pojednává o právních pramenech zaměstnávání cizinců na mezinárodní, evropské a vnitrostátní úrovni. Druhá kapitola se zabývá základními pojmy v této oblasti, problematikou povolení k zaměstnání, osobami se zvláštním režimem povolení k zaměstnání a instituty zelenou a modrou kartou. Ve třetí kapitole je pojednáno o zprostředkování zaměstnání, agenturách práce, a o zvláštnostech agenturního zaměstnávání s ohledem na zaměstnávání cizích státních příslušníků. Čtvrtá kapitola pojednává o nelegální práci,jedné z jejích forem nazvané švarcsystém a o souvisejících přestupcích, správních deliktech a trestných činech. V páté kapitole jsou rozebrány právní prameny a podmínky pohybu, pobytu a zaměstnávání obyvatel EU, EHP a Švýcarska. V šesté kapitole jsou popsány nejdůležitější judikáty související se zaměstnáváním cizinců a v poslední části jsou navrženy změny de lege ferenda. | cs |
| dc.description.abstract-translated | The topic of this diploma thesis is Legal Issues Relating to the Employment of Foreigner. First part of this thesis is an intorduction to the topic, description of aims and information about particular parts of thesis. In second chapter are described international, european and czech sources of law connected with the employment of citizens from so called third countries. The third part is focused on the work permit and the way of its achievement and also on special work permits such as Green and Blue Card. Fourth part is devoted to matters of employment agencies with regard to foreign workers. In fifth part is described an illegal employment of foreigners and special type of this employment called švarcsystem as well as procedures carried out by executional authorities and most usual faults in this branch. The sixth part attempted to look at legal sources of the employment of citizenc from European Union, European Economic Area and Switzerland. In seventh one are highlighted the most important judgments connected with this topic and in last chapter are suggested some improvements de lege ferenda. | en |
