dc.description.abstractDiplomová práce na téma "Odchylky obecné úpravy řízení o přestupcích od obecné úpravy správního řízení", se zabývá procesní úpravou přestupkového práva. Cílem práce je vyhledat, porovnat a právně analyzovat odchylky přestupkového řízení dle zákona č. 250/2016 Sb., o odpovědnosti za přestupky a řízení o nich od standardní úpravy správního řízení dle správního řádu. V diplomové práci je rovněž pojednáno o vztahu těchto dvou právních předpisů. Práce využívá komparativní metody k tomu, aby na základě přímého porovnání příslušných ustanovení obou zákonů, podala výklad o účelu a důsledcích aktuální právní úpravy přestupkového řízení. Tato hlavní materie diplomové práce je doplněna analýzou procesních zásad správního trestání, jelikož právě v těchto specifických zásadách, lze najít hlavní důvody, proč je oblast správního trestání tak zásadně odlišena od obecného správního řízení. V diplomové práci je pro snadnější orientaci postupováno systematicky dle znění části třetí přestupkového zákona.cs
dc.description.abstract-translatedThe diploma thesis on the topic "Differences between the general legislation of the offence proceedings and the general legislation of the administrative proceedings" deals with the procedural regulation of the offence law. The aim of the thesis is to find, compare and legally analyze differences of offence proceedings according to Act No. 250/2016 Coll., on Liability for Administrative Violations and Relating Proceedings from the standard legislation of the administrative proceedings according to the Code of Administrative Procedure. The diploma thesis also discusses the relatio between these two legal regulations. The thesis uses comparative methods to give an explanation of the purpose and consequences of the current legal regulation of the offence proceedings on the basis of a direct comparison of the relevant provisions of both laws. This main subject of the diploma thesis is supplemented by an analysis of the procedural principles of administrative punishment, because it is in these specific principles that one can find the main reasons why the area of administrative punishment is so fundamentally different from general administrative proceedings. In the diploma thesis, the wording of the third part of Act No. 250/2016 Coll. is systematically followed for easier orientation.en
