dc.description.abstractRigorózní práce se zabývá incidenčními spory, jež vyvstávají v jednotlivých částech insolvenčního řízení. Incidenční spory jsou popsány nejen z hlediska samotné hmotněprávní úpravy, ale hlavní akcent je kladen na jejich procesně-právní úpravu. Tomuto záměru odpovídá i zařazení části věnované zásadám, jimiž je řízení o incidenčních sporech ovládáno, na začátek rigorózní práce. V práci je analyzována zákonná úprava všech druhů incidencˇni´ch sporu°, jež jsou uvedeny v zákoně č. 182/2006 Sb., o úpadku a způsobech jeho řešení (insolvenční zákon), a to ve stavu platnému k 31. 8. 2019. Incidenční spory a řízení o nich je v práci komparováno s německou právní úpravou, jež byla předlohou pro koncepci českého insolvenčního zákona.cs
dc.description.abstract-translatedThis thesis deals with incidence disputes that arise in individual parts of insolvency proceedings. Incidental disputes are described not only in terms of substantive law itself, but the main emphasis is placed on their procedural law. This intention corresponds to the inclusion of a section devoted to the principles governing the proceedings on incidental disputes, at the beginning of the rigorous thesis. At workis analyzed the legal regulation of all types of incidental disputes, which are specified in Act No. 182/2006 Coll. Incidental disputes and proceedings on them are compared with German legislation, which was the basis for the concept of the Czech insolvency law.en
