| dc.description.abstract | Diplomová práce se zabývá institutem vydědění. V první kapitole je nastíněn historický vývoj institutu vydědění. Druhá kapitola se věnuje nepominutelnému dědici, jeho postavení, právům, povinnostem a ochraně. Třetí kapitola vysvětluje institut povinného dílu, jeho zákonnému vymezení a uplatnění práva na povinný díl nepominutelným dědicem. Následně je vysvětlena velikost povinného dílu pro zletilé a nezletilé nepominutelné dědice a započtení na povinný díl. Čtvrtá kapitola pojednává o vydědění a důvodech pro vydědění, které blíže rozvádí za použití výkladu zákona komentáři a soudní praxí. Pátá kapitola uvádí formální náležitosti vydědění. Vysvětluje tři možné způsoby vydědění, jejich náležitosti a úskalí. Šestá a poslední kapitola se věnuje institutu vydědění ve vybraných zahraničních úpravách a jejich zhodnocení v porovnání s českou právní úpravou. | cs |
| dc.description.abstract-translated | This diploma thesis focuses on institution of disinheritance. The first chapter presents historical development of disinheritance. The second chapter is devoted forced heir, his status, rights, obligations and protection. The third chapter explains the institution of the obligatory share, its legal definition and the exercise of the right to the obligatory share by the forced heir. Then it explains the size of the obligatory share for minor and non-minor heirs and the offsetting against the obligatory share. The fourth chapter deals with disinheritance and the grounds for disinheritance, which is explained by using the interpretation of the law by commentaries and case law. The fifth chapter sets out the formalities of disinheritance. It explains the three possible methods of disinheritance and their formalities. Last chapter deals with the institution of disinheritance in selected foreign legislation and its comparison with Czech legislation. | en |
