dc.description.abstractDiplomová práce se zabývá institutem laického prvku v civilním řízení v České republice, konkrétně právní úpravou účasti přísedících na soudním rozhodování. Cílem práce je analyzovat historický vývoj tohoto institutu, jeho aktuální právní rámec a následné zrušení na základě zákona č. 319/2024 Sb. Práce zohledňuje skutečnost, že institut přísedících bude kvůli přechodným ustanovením nadále aplikován v řízeních zahájených do 31. 12. 2024. Práce vychází z analýzy právních předpisů, judikatury a odborné literatury, včetně zahraničních zdrojů. Součástí je také statistické vyhodnocení účasti přísedících v civilním řízení, a to v pracovněprávních sporech. Pátá kapitola přináší případovou studii (statistiku) z Okresního soudu v Domažlicích, šestá kapitola obsahuje komparaci se zahraničními právními systémy (Slovensko, Německo, Francie, Velká Británie). Autor v závěru hodnotí přínosy a nedostatky institutu přísedících a předkládá návrhy de lege ferenda. Dospívá k závěru, že úplné zrušení laického prvku není optimální a doporučuje jeho zachování v reformované podobě.cs
dc.description.abstract-translatedThe diploma thesis deals with the institute of lay participation in civil proceedings in the Czech Republic, specifically the legal regulation of lay judges and their involvement in judicial decision-making. The aim of the thesis is to analyse the historical development of this institute, its current legal framework and its subsequent abolition by Act No. 319/2024 Coll. The thesis reflects the fact that the institute of lay judges will continue to apply in proceedings initiated before 31 December 2024 due to transitional provisions. The thesis is based on the analysis of legislation, case law and legal literature, including foreign sources. It also includes statistical data evaluating the participation of lay judges in civil proceedings, in labour law disputes. The fifth chapter presents a case study from the District Court in Domažlice, while the sixth chapter provides a comparison with foreign legal systems (Slovakia, Germany, France and the United Kingdom). In the final part, the author assesses the advantages and disadvantages of the institute and presents de lege ferenda proposals. The author concludes that the complete abolition of lay participation is not an optimal solution and recommends its retention in a reformed form.en
