Abstract

V rámci současné debaty o valorizaci výživného nabývá na důležitosti otázka úpravy jeho minimální a maximální výše. Tato problematika, spadající do oblasti rodinného práva, odráží legislativní úvahy o změně občanského zákoníku. Autor klade důraz na otázky, zda by automatická valorizace mohla skutečně zjednodušit často složité soudní řízení, aniž by opomíjela specifické potřeby a práva dítěte.

In the context of the current debate on the valorisation of maintenance, the question of adjusting the minimum and maximum amount of maintenance is gaining importance. This issue, which falls within the area of family law, reflects legislative considerations on the amendment of the Civil Code. The author emphasises the question of whether automatic valorisation could really simplify the often difficult court proceedings without neglecting the specific needs and rights of the child.
