dc.description.abstractCílem této diplomové práce je porovnat právní úpravu soudního přezkumu opatření obecné povahy před nabytím účinnosti tzv. velké novely soudního řádu správního (zákon č. 303/2011 Sb.) a po nabytí účinnosti této novely. V první kapitole této práce jsou stručně vymezeny formy činnosti veřejné správy, ve druhé části je charakterizováno opatření obecné povahy, a to i na základě znaků uvedených v první kapitole. Součástí této kapitoly je také proces tvorby opatření obecné povahy a přezkum opatření obecné povahy podle správního řádu (zákon č. 500/2004 Sb., v platném znění). Třetí kapitola popisuje soudní přezkum opatření obecné povahy před nabytí účinnosti zákona č. 303/2011 Sb. Některá ustanovení zůstala nezměněná, proto jejich výklad platí i po 1. lednu 2012. Poslední část této diplomové práce posuzuje změny provedené touto novelou. Jelikož soudní přezkum opatření obecné povahy ovlivnila také judikatura Ústavního soudu a Nejvyššího správního soudu, jejich názory jsou uvedeny na konci čtvrté kapitoly.cs
dc.description.abstract-translatedThe aim of this thesis is to compare the legislation of the judicial review of measures of general nature before the entry of the so-called large amendment into force to the Code of the Administrative Procedure (Act no. 303/2011 Coll.) and after the entry of this amendment into force. In the first chapter of this thesis, the forms of public administration are briefly defined. In the second part, a measure of general nature is characterized, with regard to the facts mentioned in the first chapter. A part of this chapter is also the process of creating the measures of general nature and the review of the measures of general nature according to the Administrative Code (Act No. 500/2004 Coll., as subsequently amended). The judicial review of the measures of general nature before the entry of Law No. 303/2011 Coll. into force is described in the third chapter. Some provisions remained unchanged, and therefore their interpretation is valid even after 1 January 2012. The last part of this thesis considers the changes made by this amendment. As the judicial review of the measure of general nature also affected the jurisprudence of the Constitutional Court and the Supreme Administrative Court, their opinions are stated at the end of the fourth chapter.en
