Tzv. flipování spoluvlastnických podílů na nemovitostech jako jeden z fenoménů současné doby

Abstract

Cílem tohoto příspěvku je představit jeden z poněkud problematických fenoménů současné doby, jímž je tzv. flipování spoluvlastnických podílů na nemovitostech, možná rizika a další okolnosti s tímto spojené. Pojem flipování prozatím nemá exaktní a univerzálně přijímanou definici, ovšem jako obecný jev lze popsat například jako spekulativní skupování spoluvlastnických podílů zejména na nemovitostech s cílem buď získat plnou kontrolu nad věcí (a z tohoto stavu pak profitovat) nebo alespoň nabytý spoluvlastnický podíl rychle přeprodat s cílem dosáhnout přitom co nejvyšší ceny. Jedná se o fenomén, který se v relativně malé míře vyskytoval vždy, nicméně v posledních několika málo letech se tento fenomén transformoval ze spíše okrajové záležitosti do hlavního podnikatelského záměru leckterých subjektů. Právě onen rychlý nárůst těchto obchodů pak jednoznačně přispěl k obecné popularizaci, a to pod příslibem rychlého a jednoduchého zbohatnutí.The aim of this article is to present one of the rather problematic phenomena of the present time, which is the so-called flipping of co-ownership shares in real estate, possible risks and other circumstances associated with this. The term flipping does not yet have an exact and universally accepted definition, but as a general phenomenon it can be described, for example, as the speculative purchase of co-ownership shares in real estate with the aim of either gaining full control over the real estate (and then profiting from this status) or to at least quickly resell the acquired co-ownership share with the aim to achieve the highest possible price. This is a phenomenon that has always occurred to a relatively small extent, however, in the last few years has transformed from a rather marginal matter into the main business plan of many entities. It is precisely the rapid growth of these transactions that has clearly contributed to their general popularization, under the promise of getting rich quickly and easily. It can be added that co-ownership shares in any thing can be so-called flipped, but real estate is the main target of speculators in this area.
