dc.description.abstractDiplomová práce je zaměřena na problematiku zániku závazků jinými způsoby než splněním v právním řádu České republiky. Úvodní kapitola se věnuje závazkům a jejich zániku v Římském právu, které tvoří základ kontinentální právní kultury. Další dvě kapitoly jsou rozděleny na zánik závazků s uspokojením věřitele a na zánik závazků bez uspokojení věřitele, jelikož takové dělení zániku závazků poskytuje i základní literatura, když jiné dělení by bylo zbytečně matoucí. Závěr práce je věnován srovnání institutů Římského a současného práva, jejich výhody či nevýhody a skutečnosti, které v současné chvíli považuji za problematické.cs
dc.description.abstract-translatedThe diploma thesis is focused on the issue of termination of obligations in other ways than fulfillment in the legal order of the Czech Republic. The opening chapter deals with the obligations and their extinction in Roman law, which form the basis of continental legal culture. The other two chapters are divided into the termination of the commitments with the creditor's satisfaction and the termination of the obligations without the creditor's satisfaction, since such division of the extinction of obligations is provided by the basic literature, when the other division would be unnecessarily confusing. The conclusion of the thesis is devoted to the comparison of the institutes of Roman and contemporary law, their advantages and disadvantages and the facts which I consider to be problematic at the moment.en
