dc.description.abstractDiplomová práce pojednává o trestném činu vraždy v českém trestním právu. Práce se zabývá otázkou vraždy nejen z pohledu současného trestního zákoníku, ale také z pohledu historického. V rámci stěžejních kapitol se práce věnuje trestnému činu vraždy z hlediska současné právní úpravy. Rozebírá jeho skutkovou podstatu, jednotlivé typy vražd, vývojová stádia a možné tresty, které lze za trestný čin vraždy pachateli uložit. V kapitole věnující se členění vražd stručně popisuje i privilegované skutkové podstaty úmyslného usmrcení. Okrajové kapitoly se věnují právu na život a jeho ochraně, otázce euthanasie a srovnání trestného činu vraždy v českém a slovenském trestním právu. Závěrem autor práce podává úvahy de lege ferenda, které by mohly současný český trestní zákoník obohatit.cs
dc.description.abstract-translatedThe thesis deals with the crime of the murder in Czech criminal law. The overview of the crime of murder is not only from current Czech criminal legislation, but also from a history of the legal regulation in our country. In the main chapters the thesis are dedicated to the current legal regulation in Czech Republic. It analyses the substantial elements of a crime of murder, stages of development and punishments that may be imposed on perpetrator. The privileged substantial elements of a crime of murder are described in the chapter devoting to categorization of murders. Marginal chapter deals with the right of life and its protection, a question of euthanasia and comparison of the crime of murder in Czech and Slovak criminal law. Eventually, the author presents considerations de lege ferenda, which could enhance the current Czech criminal code.en
