dc.description.abstractDiplomová práce se věnuje trestněprávním aspektům jednoho z úmyslných usmrcení podle současné právní úpravy, a to trestnému činu vraždy. Jsou rozebrány nejzásadnější aspekty, jako základní znaky skutkové podstaty, kategorizace vražd, vztah vraždy a privilegovaných skutkových podstat zabití a vraždy novorozeného dítěte matkou, vývojová stádia, skutkový omyl ve vztahu k vraždě nebo trestání. Práce rovněž zahrnuje komparaci české právní úpravy s úpravou švýcarskou, spolu se zahrnutím konceptu eutanázie a asistovaného umírání. Obsažen je také kriminologický exkurs se zaměřením na pachatele vražd a vraždy vícenásobné. V závěru práce autorka představuje některé náměty de lege ferenda.cs
dc.description.abstract-translatedThe thesis deals with the criminal aspects of one of the intentional killings under the current legislation, namely the crime of murder. The most important aspects are discussed, such as the substantial elements of the offence, the categorization of homicides, the relationship between homicide and the privileged offences of manslaughter and infanticide, the developmental stages, and the mistake of fact in relation to homicide or punishment. The work also includes a comparison of Czech legislation with Swiss legislation, along with the inclusion of the concept of euthanasia and assisted dying. Also included is a criminological excursus focusing on the perpetrators of murder and multiple homicides. The author concludes the thesis with some de lege ferenda suggestions.en
