dc.description.abstractTato diplomová práce se zabývá postavením a ochranou nepominutelných dědiců dle současné české právní úpravy. Práce poskytuje v rámci šesti kapitol nejprve analýzu pojmu nepominutelného dědice, jeho historický vývoj a současné postavení, včetně role nepominutelného dědice jako věřitele. Druhá kapitola pojednává o institutu povinného dílu a zaměřuje se na jeho výši, výpočet a omezení. Následující kapitoly jsou věnovány rozboru dalších práv nepominutelných dědiců, analýze vybraných případů, ve kterých nepominutelný dědic nedědí, a bližšímu vymezení institutu vydědění. Šestá kapitola se zabývá ochranou nepominutelných dědiců. Cílem této práce je poskytnout ucelenou analýzu postavení nepominutelných dědiců a jejich ochrany v platné a účinné právní úpravě.cs
dc.description.abstract-translatedThis thesis examines the status and protection of forced heirs under the current Czech legal framework. Across six chapters, it first provides an analysis of the concept of forced heirship, its historical development, and its current status, including the role of the forced heir as a creditor. The second chapter discusses the institution of the forced share, focusing on its amount, calculation, and limitations. The following chapters analyze additional rights of forced heirs, selected cases where a forced heir does not inherit, and a more detailed definition of disinheritance. The sixth chapter addresses the protection of forced heirs. The aim of this thesis is to provide a comprehensive analysis of the status of forced heirs and their protection under the applicable legal framework.en
