dc.description.abstractDiplomová práce na téma Rovnováha biologického, sociálního a právního rodičovství se snaží přiblížit význam těchto tří různých pohledů, z kterých lze na rodičovství nahlížet. Práce je systematicky rozčleněna do pěti kapitol. První kapitola, je věnována obecným pojmům rodičovství a rodina, na které lze pojmout z mnoha vědních oborů. Následující tři kapitoly jsou věnovány jednotlivým pohledům na rodičovství, tedy biologického, sociálního a právního. Kapitola o biologickém rodičovství se věnuje především procesu biologické reprodukce. Sociální rodičovství je zde pojato jako proces socializace uskutečňovaný prostřednictvím rodičů. V kapitole, která se týká právního rodičovství, je přiblížena současná právní úprava a zároveň i nová platná, přestože dosud neúčinná, právní úprava dle nového občanského zákoníku. Obsahem poslední kapitoly je komparatistika těchto tří zmiňovaných rovin. Krom jejich celkového srovnání je zde poukázáno i na případné okolnosti, kdy se jednotlivé pohledy dostanou do možného nesouladu. Příkladně je to demonstrováno na dvou institutech, ke kterým se tento nesoulad váže, konkrétně na institutu náhradní výchovy a v souvislosti s asistovanou reprodukcí na náhradním mateřství.cs
dc.description.abstract-translatedThe Topic of my graduate work is The Balance of the Biological, Social and Legal Parenthood. In my intention there is the explamation all specific of the three difference views of parenthood which are very important in the life and growth of a human. In the introductive chapter the general definitions of the terms parenthood are explained. According to the title the next part of the work is structured into the chapters, which describe a particular views of the parenthood. The biological parenthood is the relationship between a child and the parents based on the genetic kinship. The biological parents is always only the person who gives his gamet to conception of the child, regardless of a natural or artificial method of fertilization. The answer of the question: "Who are the social parents?" depends mainly on the real care about the child. The social parent is the person who takes care about the child, brigs up and imparts his experience. There isn't necessarily in conformity with biological and legalreality. Legal meaning of the parenthood contains mainly the statutory relationship between a child and a parent which is the core base for other obligations and also the moral axioms. This chapter describes the Czech legal institutes of the family law, especially paternity law, parental rights and responsibility which is contained in current law and also in upcoming new civil codex. Last chapter is assigned to the comparison of these three forms. The first part of this chapter comprises discrepancy between the biological and the social parenthood and demonstrates the solution to the Czech legal institut - the substitute family or azyl care. The second part contains the issues depended ot the discrepancy between the biological and the legal parenthood, which could be a result of the assisted reproductive technology.en
