| dc.description.abstract | Diplomová práce se zabývá institutem práva stavby upraveným v zákoně č. 89/2012 Sb., přičemž celá práce je členěna do celkem 7 kapitol. Před první kapitolou jsou v úvodu vytyčeny cíle této diplomové práce, jejichž splnění si autor práce předsevzal. První kapitola je věnována terminologii související s právem stavby. Druhá kapitola je věnována krátkému historickému exkurzu práva stavby. Třetí kapitola je věnována institutu superficies solo cedit. Čtvrtá kapitola je věnována samotnému institutu práva stavby dle platné právní úpravy. Pátá kapitola je věnována právu stavby v judikatuře soudů České republiky. Šestá kapitola je věnována právu stavby zejména z hlediska jeho využitelnosti v praxi. Poslední kapitola je věnována zhodnocení práva úpravy institutu práva stavby a návrhům de lege ferenda. V závěru autor této práce shrnuje obsah výše uvedených kapitol a uvádí, že veškeré cíle této práce považuje za splněné. Zároveň autor naznačuje, že institut práva stavby je v praxi sice poměrně hojně využíván, nicméně právní úprava tohoto institutu není nastavena vhodně a bude tedy potřeba vyčkat zejména soudních rozhodnutí soudů České republiky, které (snad) vyřeší některé sporné otázky vyplývající z právní úpravy celého institutu práva stavby. | cs |
| dc.description.abstract-translated | The diploma thesis deals with the institute of right of superficies regulated in Act No. 89/2012 Coll. while the entire thesis is divided into a total of 7 chapters. Before the first chapter itself, the goals of this diploma thesis are outlined in the introduction, the fulfillment of which the author of this thesis set out to achieve. The first chapter itself is then devoted to terminology related to the right of superficies. The second chapter is devoted to a short historical excursion of the right of superficies. The third chapter is devoted to the institute of superficies solo cedit. The fourth chapter is dedicated to the right of superficies itself according to the applicable legislation. The fifth chapter is devoted to the right of superficies in the jurisprudence of the courts of the Czech Republic. The sixth chapter is devoted to the right of superficies, especially from the point of view of its usability in practice. The last chapter is devoted to the evaluation of the right to adjust the right of superficies and de lege ferenda proposals. In the conclusion, the author of this thesis summarizes the content of the above chapters and states that he considers all the objectives of this thesis to have been fulfilled. At the same time, the author then suggests that the right of superficies is used relatively widely in practice, however, the legal regulation of this institute is not set up appropriately and it will therefore be necessary to wait in particular for the court decisions of the courts of the Czech Republic, which will (hopefully) resolve some controversial issues arising from the legal adjustments to the entire right of superficies. | en |
