dc.description.abstractTato diplomová práce se zabývá problematikou smluv a smluvních vztahů v IT a to konkrétně smluv aplikovaných při celém životním cyklu softwaru bez ohledu na to zda se jedná o jeho vývoj či dispozici s ním. Hlavním cílem je uvedení smluvních typů užívaných v IT z pohledu zákona č. 89/2012 Sb., Občanského zákoníku ale i těch, o kterých zákon výslovně nehovoří a následné podřazení konkrétních smluv v IT pod tuto typologii a specifikování materiálních náležitostí těchto smluv spolu s reflexí moderních technologických i smluvních trendů do těchto smluv.cs
dc.description.abstract-translatedThis diploma thesis analyses the issues of contracts a and contractual relations within the IT sector, specifically the contracts used in connection with the lifecycle of software regardless whether they contain development or distribution. The main purpose of this thesis is to adduce contract types in accordance to the act No. 89/2012 coll., Civil code, also considering those that the civil code does not specifically mention and followingly to subordinate these types under the typology. Additionally material properties of these contracts with the reflection of modern technological and legal trends shall be provided.en
