dc.description.abstractTato práce pojednává o náhradě nemajetkové újmy při ublížení na zdraví. Autor se tomuto institutu věnuje nejen z pohledu aktuálně platného práva, ale zmiňuje rovněž jeho historický vývoj na území České republiky. Součástí práce je také komparace současné právní úpravy s právní úpravou předcházející. Autor se dále věnuje jednotlivým nárokům plynoucích ze zásahu do tělesné a duševní integrity a rozebírá nejen jejich povahu, ale taktéž způsob vyčíslení dle metodiky Nejvyššího soudu a praktické aspekty uplatňování těchto nároků u soudu. V neposlední řadě jsou zmiňovány nároky sekundárně poškozených obětí, a to opět ze zcela praktického hlediska. Autor se zabývá okolnostmi, jež musí obecné soudy hodnotit v případech, kdy rozhodují o nárocích sekundárně poškozených osob. Na závěr práce je zařazena komparace české právní úpravy se španělskou právní úpravou.cs
dc.description.abstract-translatedThis thesis refers about the compensation for non-pecuniary harm in the case of bodily harm; in this thesis the author deals with this institute not only in terms of the currently applicable and acceptable law, but also through a historical overview of the development of this institute in the Czech Republic, including a comparative comparison of the current legislation with the previous legislation. The author also deals with individual demands arising from physical and mental harm, where the author analyzes not only their nature, but also the method of quantification according to the Supreme Court methodology and the practical aspects of exercising these claims in court. Moreover, the claims of second victims are mentioned, again from a practical point of view, where the author mentions circumstances that the general courts must assess in cases where they decide on dealing with claims of secondary victims. At the end of the thesis, a comparison of the Czech legislation with the Spanish legislation is included.en
