K (ne)aplikaci § 128 OSŘ při poskytování součinnosti exekutorovi třetími osobami

Abstract

Exekuční řízení vyžaduje aktivní zapojení různých subjektů, mezi které patří nejen samotní účastníci řízení, ale také třetí osoby, jimiž jsou např. orgány státní správy, finanční instituce či telekomunikační společnosti. Jejich součinnost může výrazně ovlivnit úspěšnost exekuce a její rychlost.Tento příspěvek se zaměřuje na problematiku povinnosti třetích osob poskytovat součinnost exekutorovi a vymezení okruhu povinných informací, které jsou nezbytné pro efektivní průběh exekučního řízení. Text se pokusí objasnit, které osoby a v jakém rozsahu jsou povinny poskytovat součinnost, a to zejména v kontextu možné aplikovatelnosti § 128 OSŘ v rámci exekučního řízení. To je v praxi poměrně často předmětem sporů. Klíčovou otázkou v tomto směru je, zda úprava poskytování součinnosti exekutorovi obsažená v exekučním řádu obsahuje úplný výčet možných povinných subjektů a informací, které může exekutor požadovat, nebo zda je možné aplikovat extenzivní výklad a tudíž i § 128 OSŘ. Daná otázka je sice hojně diskutována v odborné literatuře a judikatuře, nicméně doposud nebyla podrobena důkladnější analýze a závěry dosavadní diskuse nejsou jednoznačné.

Enforcement proceedings require the active involvement of various entities, including not only the parties to the proceedings themselves, but also third parties such as government agencies, financial institutions, and telecommunications companies. Their cooperation can significantly influence the success and speed of enforcement.This article focuses on the issue of third parties’ obligation to cooperate with the Bailiff and defines the scope of information required for the effective conduct of enforcement proceedings. The text will attempt to clarify which persons and to what extent are obligated to provide cooperation, particularly in the context of the potential applicability of Section 128 of the Code of Civil Procedure within enforcement proceedings. This is quite often the subject of disputes in practice. The key question in this regard is whether the provisions governing cooperation with the enforcement officer contained in the Enforcement Code provide a complete list of potential obligated parties and the information the enforcement officer may request, or whether it is possible to apply a broad interpretation and, consequently, Section 128 of the Code of Civil Procedure. Although this issue is widely discussed in the professional literature and case law, it has not yet been subjected to a thorough analysis, and the conclusions of the discussion to date are not clear-cut.
