Elektronické doručování zaměstnavatelem po novele zákoníku práce

Abstract

Novela zákoníku práce přinesla do pracovního práva část podstatných změn, mezi něž patří mimo jiné i úprava dosavadních pravidel pro doručování a elektronizaci dokumentů, která je v praxi mezi zaměstnavateli stále častějším tématem. Novela tak umožňuje přiblížit se celkové digitalizaci pracovněprávních procesů v oblasti lidských zdrojů. Digitalizace pracovněprávních dokumentů by měla přinést i další výhody jako například snadnou dohledatelnost dokumentů, jejich bezpečné uložení, a také zvýšit efektivitu a snížit náklady zejména zaměstnavatelům. V tomto článku se budeme věnovat elektronizaci pracovněprávních dokumentů z pohledu zaměstnavatele, přičemž se zaměříme zejména na právní úpravu podpisů pracovněprávních dokumentů, jejich formu, doručování a archivaci.

The amendment of the Labour Code brought some significant changes to the labour law, including, among others, the modification of the existing rules for the delivery and electronicisation of documents, which is an increasingly frequent topic among employers in practice. Thus, the amendment allows to move closer to the overall digitalisation of labour law processes in the field of human resources. The digitisation of employment documents should also bring other benefits, such as easy traceability of documents, their safe storage, as well as increased efficiency and reduced costs, especially for employers. In this article, we will discuss the digitization of employment documents from the employer's perspective, focusing in particular on the legal regulation of signatures of employment documents, their form, delivery and archiving.
