| dc.description.abstract | Soudní smír je procesním institutem často opomíjeným právní naukou i právní praxí. Podnět k jeho hlubšímu doktrinálnímu zkoumání nepřichází ani od samotných účastníků, neboť mnohdy před smírným řešením sporu upřednostní autoritativní rozhodnutí soudu. Rigorózní práce přibližuje soudní smír jakožto procesní úkon s dvojí funkcí z pohledu nauky o jeho dvojí povaze a nauky o jeho dvojí skutkové podstatě, jež se rozvinuly zejména v Rakousku a Německu. Jejich východiskům je soudní smír podroben především ve spojitosti s následky vad v jeho procesní, resp. hmotněprávní stránce. Pozornost je věnována i způsobům nápravy vadného smíru, jež jsou komparovány se zahraničními úpravami. Rigorózní práce se zabývá rovněž otázkou ingerence soudu v podobě schvalování smíru. Stranou rozboru nezůstaly ani jeho účinky na poli procesním a hmotněprávním. | cs |
| dc.description.abstract-translated | Judicial settlement is a procedural institute often neglected by legal doctrine and practice. The impetus for its deeper doctrinal examination does not even originate from the parties themselves, as they often prefer an authoritative decision of the court to an amicable settlement of the dispute. The rigorous thesis presents judicial settlement as a procedural act with a dual function from the perspective of the doctrine of its dual nature and the doctrine of its dual facts, which developed especially in Austria and Germany. The judicial settlement is subjected to their premises in particular in connection with the consequences of defects in its procedural or substantive aspects. Attention is also paid to the methods of remedying a defective settlement, which are compared with foreign legislation. The thesis further examines the issue of the court's intervention in the form of approving the settlement. Its effects in the field of procedural and substantive law are also included in the analysis. | en |
