dc.description.abstractDiplomová práce na téma "Rodičovská odpovědnost se zaměřením na nositelství a výkon" obecně definuje institut rodičovské odpovědnosti, včetně jeho obsahu a historického kontextu. Hlavní část práce se však zaměřuje na klíčové složky tohoto institutu, konkrétně na nositelství a výkon rodičovské odpovědnosti. Kapitola o nositelství se soustředí na vymezení pojmu, podmínky vzniku a subjekty, kterým tento institut přísluší. V části o výkonu rodičovské odpovědnosti práce rozebírá podmínky a subjekty oprávněné vykonávat rodičovskou odpovědnost, včetně zaměření na specifické situace, na něž právní úprava reaguje, a na roli dítěte, jehož postavení je stále více akcentováno v souladu s mezinárodními standardy a judikaturou. Závěrem se práce věnuje zásahům veřejné moci do rodičovské odpovědnosti a zkoumá jejich vliv na instituty, kterým byla práce primárně věnována. Ačkoliv právní úprava přisuzuje důležitou roli soudu, často bývá opomíjena role orgánu sociálně-právní ochrany dětí, který má rovněž prostředky k zásahu do rodičovské odpovědnosti.cs
dc.description.abstract-translatedThe thesis on "Parental responsibility with a focus on holding and exercise" generally defines the institution of parental responsibility, including its content and historical context. The main part of the thesis, however, focuses on the key components of this institute, namely the holding and exercise of parental responsibility. The chapter on holding focuses on the definition of the concept, the conditions of its creation and the subjects to whom the institute belongs. In the section on the exercise of parental responsibility, the thesis analyses the conditions and subjects entitled to exercise parental responsibility, including a focus on the specific situations to which the legislation responds and on the role of the child, whose position is increasingly emphasised in line with international standards and case law. Finally, the thesis examines the interventions of the public authorities in parental responsibility and explores their impact on the institutes that were the primary focus of the thesis. Although the legislation attributes an important role to the court, the role of the child welfare authority, which also has the means to intervene in parental responsibility, is often neglected.en
