Abstract
Článek se věnuje právní úpravě a praktickým aspektům práva vlastníků bytových jednotek na nahlížení do podkladů k vyúčtování služeb sestaveného společenstvím vlastníků jednotek (SVJ). Autor analyzuje povinnosti SVJ dle zákona č. 89/2012 Sb., občanský zákoník, a zákona č. 67/2013 Sb., o poskytování služeb, a změny těchto předpisů. Zdůrazňuje důležitost transparentnosti a správného postupu SVJ při vyúčtování, včetně možnosti opakované kontroly správnosti vyúčtování příjemci služeb. Závěrem navrhuje de lege ferenda úpravy pro zvýšení právní jistoty a efektivity kontroly vyúčtování. Článek čerpá z judikatury Nejvyššího soudu ČR a odborné literatury.
The opportunity to access the records from which the service billing is compiled by the condominium association, is the legal right of any unit owner. This right is in accordance with the law, and it imposes an obligation on the service provider to document, in compliance with the law, the costs associated with individual services, the method of their allocation, the method of determining service fees, and the execution of billing. Simultaneously, it allows the unit owner to obtain a copy of these records. The legal framework regarding certain aspects of accessing billing records is somewhat ambiguous. The essence and purpose of the legal regulations, which have been the subject of my legal analysis, aim to enable effective control of the accuracy and correctness of service fee billing and determination by the service recipient. It is evident that this control cannot occur without the service recipient having real access to the documentation upon which the billing is based.
