dc.description.abstractDiplomová práce se zabývá prostředky ochrany osobnosti s ohledem na vývoj současné judikatury. V práci je nejprve podán krátký historický exkurz s několika příklady z dějin lidstva. Následuje popis ochrany osobnosti, jako základního lidského práva, i s ohledem na prameny mezinárodní, ústavní a zákonné. V další kapitole jsou popsány jednotlivá osobnostní práva a také problematika ochrany osobních údajů. Po této kapitole následují příklady z té nejaktuálnější judikatury, která se s tématem diplomové práce pojí. Poslední kapitolou, která je těžištěm celé práce, jsou jednotlivé prostředky ochrany osobnostních práv a jejich využití v praxi.cs
dc.description.abstract-translatedThis diploma thesis concerns with the issues of personality protection where the point is focused on the means of this protection. The goal is mainly to submit a brief overview of particular means of protection and the way of their usage. The thesis is gradually divided into several parts. In a first part, there is submitted a short historical excursion. The following chapter concerns with the personality protection as one´s essential human right, at the same time, based in the crucial international law documents dealing with human rights, and protection of a person. The next chapter describes the person protection in more details, especially as it is based on the general clause which is included in a civil code, besides secondary law is not omitted. There is also given a description of personal data protection in this chapter as it is provided for a law of personal data protection. The thesis also involves a description of some fundamental judical decisions connected with the aplication and development of person protection in a czech legal code after 1989. The last chapter, which is nevertheless the core of the diploma thesis with the extant of its whole half, involves the particular means of protection of personality.en
