dc.description.abstract	Diplomová práce pojednává o občanskoprávním institutu služebností a zaměřuje se na komplexní rozbor této problematiky. V úvodu práce je stručně popsána evoluce služebností počínající již ve starověkém Římě, která pak prostupuje dějinami napříč různými právními kodexy až po současnou platnou úpravu obsaženou v zákoně č. 89/2012 Sb., občanském zákoníku. Následující pasáže jsou věnovány již zmíněné aktuální právní úpravě tohoto institutu, kdy nejprve pojednávám o jednotlivých druzích pozemkových a osobních služebností, jakožto věcných právech k věci cizí, přičemž jsou jednotlivé druhy doprovázeny taktéž soudní judikaturou, která řeší případné nejasnosti, či spornosti, jež mohou v praxi vyvstat. V dalších kapitolách je pak pozornost věnována všem možným způsobům nabytí služebností, ať už soukromoprávními tituly nebo i tituly veřejnoprávními, a následně i právním poměrům vyplývajícím ze služebností, kdy se zejména zaměřuji na náklady spojené se služebnou věcí, případný převod služebnosti nebo možnosti ochrany výkonu práv ze služebnosti. Závěrečná kapitola této práce pak řeší možné způsoby zániku služebností.	cs
dc.description.abstract-translated	The thesis deals with the civil law institute of servitudes and focuses on a comprehensive analysis of this issue. In the introduction of the thesis, the evolution of servitudes is briefly described, starting in ancient Rome, which then goes through history across various legal codes up to the current valid regulation contained in Act No. 89/2012 Coll., the Civil Code. The following passages are devoted to the above mentioned current legal regulation of this institute, where I first deal with the individual types of land and personal servitudes, as encumberances, whereby the individual types are also accompanied by judicial case law that resolves any obscurities or disputes that may arise in practice. In the following chapters, attention is then paid to all possible ways of acquiring servitudes, whether by private law titles or public law titles, and subsequently to the legal relations arising from servitudes, focusing in particular on the costs associated with the servitude, the possible transfer of the servitude or the possibilities of protecting the execution of rights under the servitude. The final chapter of this thesis deals with the possible ways of termination of servitudes.	en
