dc.description.abstractPředkládaná diplomová práce se zabývá poměrně novým institutem trestního práva procesního, a to dohodou o vině a trestu, která byla do právního řádu České republiky začleněna novelou trestního řádu provedenou zákonem č. 193/2012 Sb., s účinností od 1. září 2012. Na úvod je popsán současný stav možností využití odklonů v trestním řízení. Další části diplomové práce jsou věnovány podrobnému rozboru institutu dohody o vině a trestu, jeho podstatě, podmínkám uplatnění a též výhodám a nevýhodám tohoto institutu, jakož i vztahu tohoto k základním zásadám českého trestního řízení. Práce obsahuje rovněž srovnání se zahraniční právní úpravou a úvahy de lege ferenda.cs
dc.description.abstract-translatedThis presented thesis deals with the relatively new institute of the criminal procedure, namely the Agreement on guilt and punishment that was implemented into Czech law by an amendment of the Code of Criminal Procedure, namely by the Act no. 193/2012 Sb., effective from September 1, 2012. At the beginning, there is a description of the valid status of diversions utilization in the Czech procedural law. Next parts are focused on more specific analysis of the new institute, its essence, conditions of application, advantages and disadvantages of the agreement on a guilt and punishment and its relation to the basic principles of Czech criminal law. The thesis includes a comparative excursus into the foreign legal regulations and the considerations de lege ferenda.en
