dc.description.abstractDiplomová práce se zabývá mimořádnými a krizovými opatřeními v průběhu pandemie COVID-19. Práce je rozdělena do 5 kapitol. První kapitola popisuje, která omezení byla přijímána během pandemie COVID-19. Ve druhé kapitole uvádím hlavní právní předpisy, které byly používány během pandemie a také se věnuji otázce, jakou právní povahu mají krizová a mimořádná opatření. Třetí kapitola se věnuje soudnímu přezkumu krizových a mimořádných opatření. Zde uvádím nejvýznamnější vady, na základě kterých byla opatření ze strany soudů rušena. Ve čtvrté kapitole se věnuji protiústavně vyhlášenému nouzovému stavu ze 14. února 2021. V tomto případě vláda obešla Sněmovnou vyslovený nesouhlas s delším trváním přes žádosti hejtmanů o vyhlášení nouzového stavu a vyhlásila nouzový stav nový. Poslední pátá kapitola se věnuje srovnání se zahraniční právní úpravou pro zvládnutí pandemie (a to konkrétně na Slovensku, v Německu a Polsku).cs
dc.description.abstract-translatedThe diploma thesis deals with emergency and crisis measures during the COVID-19 pandemic. The work is divided into 5 chapters. The first chapter describes which restrictions were adopted during the COVID-19 pandemic. In the second chapter, I present the main legal regulations that were used during the pandemic and also address the question of the legal nature of crisis and emergency measures. The third chapter is devoted to the judicial review of crisis and emergency measures. Here I present the most significant defects on the basis of which the measures were annulled by the courts. In the fourth chapter, I deal with the unconstitutionally declared state of emergency on February 14, 2021. In this case, the government bypassed the House of Representatives' expressed opposition to a longer duration despite the governors' requests to declare a state of emergency and declared a new state of emergency. The last, fifth chapter is devoted to a comparison with foreign legislation for handling the pandemic (specifically in Slovakia, Germany and Poland).en
