Rodina jako kriminogenní faktor

Abstract

Příspěvek je zaměřen na problematiku vycházející ze tří vědních oborů. Rodina jako kri- minogenní faktor v sobě ukrývá zkoumání kriminogenního faktoru v souvislosti s etio- logií kriminality. Tato kriminalita je pak demonstrována na příkladech trestných činů pá- chaných uvnitř rodiny. Takto páchaná trestná činnost však nemá pouze dopady v rovině trestního práva, ale má i své občanskoprávní konsekvence. Tyto souvislosti spočívají ve způsobech zásahu soudu do rodičovské odpovědnosti. Příspěvek tak tuto problematiku zpracovává a analyzuje v duchu těchto vědních oborů a syntetizuje dosažených poznatků ve výstup, který na příkladech a v souvislostech dokládá tvrzení, že rodina je za jistých okolností kriminogenním faktorem.

The paper focuses on issues emanating from three disciplines. As a criminogenic factor, the family harbours an examination of the criminogenic factor in the context of the aetiology of criminality. This crime is then demonstrated by examples of crimes committed within the family. However, crime committed in this way not only has implications in terms of criminal law, but also has its own civil consequences. These links lie in the ways in which the court intervenes in parental responsibility. The paper thus processes and analyzes this issue in the spirit of these scientific disciplines and synthesizes the lessons learned in an output that, in examples and contexts, illustrates the claim that family is, under certain circumstances, a criminogenic factor.
