dc.description.abstractTato diplomová práce na téma "Nepovolená stavba v judikatuře správních soudů" pojednává o problematice "černých staveb", tedy staveb nepovolených dle stavebního zákona. Hlavní náplní práce je práce s judikaturou správních soudů, tedy soudů krajských a Nejvyššího správního soudu. V práci jsou nejprve vymezeny základní pojmy, se kterými je nejčastěji pracováno. Takovými pojmy jsou stavba, nepovolená stavba (tzv. černá stavba), neoprávněná stavba a další. Následuje kapitola věnující se významu a závaznosti judikatury soudů činných na úseku správního soudnictví v českém právu. Pozornost ve stěžejní části práce je zaměřena na hmotněprávní i procesněprávní aspekty nepovolených staveb. Vybraná judikatura je pak zařazována průběžně k probíraným oblastem. Práce dále obsahuje úvod, závěr a cizojazyčné resumé.cs
dc.description.abstract-translatedThis thesis called "Illegal Construction in the Practice of Administrative Courts" discusses about the issue of "black building", properly speaking illegal construction by the building Act. The main focus of the thesis is confrontation with the practice of administrative courts, especially regional courts and The Supreme Administrative Court. In the thesis are at first defined basic concepts, which are using quite often. Such concepts are construction, illegal construction ("black building"), unauthorized construction and other terms. The next chapter deals with the importance and relevance of the practice of administrative courts in the Czech law. The main part is focused on substantive and procedural aspects of the illegal constructions. Selected case law is continuously including in discussed topics. The thesis also contains an introduction, conclusion and foreign language resume.en
