Na tenkém ledě: transparentnost trestního řízení a ochrana osobnosti v digitální době

Abstract

Článek se zabývá velice aktuální problematikou, kterou je střet mezi požadavkem na transparentnost trestního řízení a nutností chránit osobnostní práva jednotlivců v digitální době. Současné digitální technologie umožňují, aby se informace o probíhajících trestních řízeních šířily okamžitě a zůstávaly trvale dostupné online, což zvyšuje riziko zásahů do soukromí a pověsti dotčených osob. V této souvislosti práce analyzuje současný český legislativní rámec a relevantní soudní praxi. Zároveň zkoumá, jak mediální zpravodajství, sociální sítě a další online platformy ovlivňují právo na soukromí účastníků řízení a presumpci neviny obviněných. Prostřednictvím analýzy případových studií několika medializovaných trestních řízení a komparace s německou právní úpravou článek ilustruje praktické dopady tohoto napětí a odhaluje rozdíly v přístupu k ochraně soukromí v trestním řízení. Hlavním cílem práce je navrhnout možné způsoby, jak efektivně vyvážit veřejný zájem na otevřenosti trestního řízení s ochranou individuálních práv jeho účastníků. Závěry článku proto obsahují doporučení pro praxi, která mohou napomoci nastolit rovnováhu mezi otevřeností soudnictví a zachováním práva na soukromí, dobré pověsti a presumpce neviny dotčených osob v digitální době.

The article addresses a highly topical issue: the conflict between the demand for transparency in criminal proceedings and the need to protect individual personality rights in the digital age. Modern digital technologies enable the instantaneous dissemination of information about ongoing criminal cases, with such information often remaining permanently accessible online. This increases the risk of intrusions into the privacy and reputation of the individuals concerned. In this context, the article analyses the current Czech legislative framework and relevant case law. It also examines how media coverage, social networks, and other online platforms impact the right to privacy of the parties involved and the presumption of innocence of the accused. Through the analysis of case studies involving several high-profile criminal proceedings and a comparison with German legal regulation, the article illustrates the practical consequences of this tension and highlights differences in approaches to privacy protection within criminal justice. The main aim of the article is to propose viable ways to effectively balance the public interest in transparent criminal proceedings with the protection of individual rights of those involved. The conclusions include recommendations for practice that may help achieve an appropriate balance between judicial openness and the preservation of the right to privacy, good reputation, and the presumption of innocence in the digital era.
