dc.description.abstractDiplomová práce zprostředkovává analýzu konkrétního institutu dědického práva, a to jmenovitě přechod pozůstalosti na dědice dle aktuálně platného a účinného zákona č. 89/2012 Občanský zákoník, ve znění pozdějších předpisů. Autor popisuje a analyzuje všechny specifické segmenty institutu přechodu pozůstalosti. Tato část je stěžejním bodem a cílem této práce, čemuž odpovídá pozornost, která je tomuto institutu věnována z hlediska objemu textu a počtu podkapitol, které se mu věnují. Autor také stručně přibližuje současnou legislativou tohoto institutu v rakouském právu. Důvodem k tomu je dlouhé historické provázání obou těchto právních řádů a rovněž také nedávná obsáhlá změna rakouského občanského práva k 1. 1. 2017 které je též věnována stručná kapitola v této práci, kde autor přibližuje některé rysy této novelizace. Tato práce také obsahuje stručný popis vývoje tohoto institutu v čase.cs
dc.description.abstract-translatedThe diploma thesis provides an analysis of one specific institute of succession law, namely the transition of the estate to the heirs according to the current Czech legislation No. 89/2012 Civil Code, as amended. The author describes and analyse all specific segments of this institute as the transition of the estate goes. This part is the focus and the centre of this thesis and the attention on this chapter is reflected in the volume of subchapters and paragraphs devoted to it. The author also briefly deals with the current legislation of this institute in Austrian law. The reason for this is the historical connection of these two legal systems, as well as recent changes in the form of massive and vital amendments to both legal systems regarding law of succession but especially the Austrian succession law amendment in effect from 1. 1. 2017 that has dedicated chapter in this work. This thesis also contains a brief description of the development of this institute in time.en
