dc.description.abstractTato diplomová práce se zabývá trestnými činy proti životu a zdraví spáchanými z nedbalosti. Nejprve je analyzována subjektivní stránka trestného činu z hlediska zavinění, se zaměřením na jednotlivé formy nedbalosti. Následuje historický exkurz do vývoje právní úpravy nedbalostních trestných činů. Těžiště práce tvoří rozbor jednotlivých skutkových podstat těchto trestných činů. Významná část je věnována judikatuře, zejména v oblasti medicíny, dopravních nehod a pracovních i lyžařských úrazů. Práce rovněž obsahuje komparaci s německou právní úpravou a v závěru formuluje úvahy de lege ferenda.cs
dc.description.abstract-translatedhis thesis deals with crimes against life and health committed through negligence. First, the subjective aspect of the crime is analysed in terms of culpability, focusing on the various forms of negligence. This is followed by a historical excursion into the development of the legal regulation of negligent crimes. The focus of the thesis is the analysis of the individual facts of these crimes. A significant part is devoted to case law, especially in the field of medicine, traffic accidents and work and skiing accidents. The work also includes a comparison with German legislation and concludes with de lege ferenda considerations.en
