dc.description.abstractDiplomová práce pojednává o srovnání nákladů exekučního a insolvenčního řízení. Je systematicky dělena do pěti částí. Základem práce je definice řízení jako takových a jejich vztahu, pojmosloví, jež se s danou problematikou pojí a subjektů, kterým vznikají náklady v průběhu exekučního a insolvenčního řízení. Druhá polovina práce se již zaobíra problematikou dílčích nákladů a uvádí jejich konkrétní výši, výpočet a způsob rozhodování o jejich náhradě. Cílem práce bylo kriticky analyzovat jednotlivé náklady obou řízení v kvalitním obrazu aktuální právní úpravy a naleznout, zdali jsou náklady řízení srovnatelné či nikoliv. Dále práce poukazuje na vybrané shody a odlišnosti nákladů. Závěrem práce je definování příčin vznikajících rozdílů nákladů obou řízení vedle sebe a navrhnutí řešení.cs
dc.description.abstract-translatedThis thesis deals with the comparison of the costs between enforcement and insolvency proceedings. It is systematically divided into five parts. The basis of the thesis is the definition of the proceedings as such and their relationship, the terminology related to the issue and the subjects who incur costs in the course of enforcement and insolvency proceedings. The second half of the thesis deals with the issue of partial costs and presents their specific amount, calculation and the method of deciding on their compensation. The aim of the work was to critically analyse the individual costs of both proceedings in a qualitative picture of the current legislation and to find out whether the costs of the proceedings are comparable or not. Furthermore, the thesis highlights selected similarities and differences in costs. The thesis concludes by defining the causes of the cost differences between the two proceedings side by side and proposing solutions.en
