dc.description.abstractTato diplomová práce se zabývá problematikou výjimečného trestu odnětí svobody, jeho historickým vývojem, platnou právní úpravou v trestním právu hmotném, jakožto i právní úpravou výkonu tohoto trestu a penologickými aspekty jeho uložení. Dále jsem v této práci provedla krátké srovnání se zahraniční právní úpravou, konkrétně pak úpravou slovenskou a německou.Do obsahu jsem zahrnula i ukládání výjimečného trestu odnětí svobody v právní praxi, a to zpracováním tří právních věcí, ve kterých byl výjimečný trest pravomocně uložen.cs
dc.description.abstract-translatedThe name of this thesis is "Exceptional sentence". Its subject matter deals with the concept of the sentence itself, its purpose and meaning, further on with the specific definition of exceptional sentence and its specifics in the Substantive Criminal Law.What I follow up next is the historical development of punishment, imprisonment, and of course the development of the institute of exceptional sentence.In the thesis I try to compare this treatment in the Czech legal system with legal systems of other European countries, namely of Slovakia and Germany. The last chapter is devoted to legally imposed exceptional sentences, the perpetrators of specific offenses and to the analysis of the conditions, why these sentences were imposed.en
