| dc.description.abstract | Jako téma své diplomové práce jsem si vybrala zánik trestní odpovědnosti. Ve své práci se zabývám nejen platnou právní úpravou, ale i drobným exkursem do historie jednotlivých institutů. Nejprve jsem se snažila vymezit základní pojmy týkající se dané problematiky a stručně charakterizovat důvody způsobující zánik trestní odpovědnosti. Následují kapitoly, které se zabývají jednotlivými okolnostmi způsobujícími zánik trestní odpovědnosti a jejich právní úpravou, s odkazem na judikaturu českých soudů. Následně jsem se věnovala procesním důsledkům vzniku a aplikace těchto institutů. Práce je ukončena stručnou komparací české (trestně)právní úpravy s právním řádem Slovenské republiky. Mým cílem bylo pokusit se o shrnutí této problematiky, tak aby byl dán ucelený a srozumitelný obraz o jednotlivých okolnostech způsobujících zánik trestní odpovědnosti a jejich aplikaci. | cs |
| dc.description.abstract-translated | For my thesis I chose the topic of extinction of criminal liability. In my thesis I deal with not only the applicable legislation, but also to small excursion into the history of the individual institutes. At first I tried to define the basic concepts related to the issue and briefly describe the reasons leading to the extinction of criminal liability. Followed by chapters dealing with different circumstances leading to the extinction of criminal liability and their legislation, with reference to decisions of the Czech courts. Then I attended to the procedural consequences of the emergence and application of these institutes. The thesis is concluded by comparison Czech (criminal) law with the law of the Slovak Republic. My purpose was to try to summarize this issue, so that has been given a complete and clear picture of the circumstances leading to the extinction of criminal liability and their application. | en |
