dc.description.abstractHlavním smyslem této rigorózní práce bylo zaměření se na způsoby vymáhání solidárních mechanismů z přestupů sportovců u sportovní arbitráže. Jelikož se jedná o ojedinělé téma svého druhu, bylo nezbytné práci koncipovat do několika přehledných kapitol, kdy každá z těchto kapitol se soustředila na samostatnou dílčí problematiku, jejíž pochopení bylo však potřebné pro naplnění cílů této práce, a tedy pro objasnění způsobů vymáhání solidárních mechanismů z přestupů sportovců u sportovní arbitráže.<br>Z tohoto důvodu byly jednotlivé kapitoly rozděleny tak, aby v první kapitole byly blíže objasněny dva nejdůležitější pojmy, bez kterých by solidární mechanismy ani nevznikaly, a tedy by je nebylo logicky možné ani vymáhat. Druhá kapitola cílila na sportovní strukturu, a i tedy sportovní subjekty, které mohou tyto mechanismy nárokovat, tak vymáhat. Třetí kapitola přiblížila alternativní způsoby řešení sporů, zejména řešení sporů u klasické a sportovní arbitráže, u níž se právě solidární mechanismy vymáhají. Čtvrtá kapitola pojednávala o přestupech sportovců, které jsou spouštěčem pro uplatnění solidárních mechanismů. Pátá kapitola detailně objasňovala podmínky, za kterých solidární mechanismy vznikají, včetně znázornění jejich výpočtu, aby v následné kapitole šesté byly konečně znázorněny způsoby vymáhání těchto mechanismů u sportovní arbitráže, a to v závislosti na stupni sportovní struktury.cs
dc.description.abstract-translatedmechanisms from athlete transfers in sports arbitration. As this is a unique topic of its kind, it was necessary to structure the thesis into several clear chapters, each of which focused on a separate sub-issue, the understanding of which was necessary to fulfil the objectives of this thesis, i.e. to clarify the methods of enforcing solidarity mechanisms from transfers of athletes in sports arbitration.<br>For this reason, the chapters were divided in such a way that the two most important concepts, without which solidarity mechanisms would not even arise, and thus would not logically be enforceable, were explained in more detail in the first chapter. The second chapter aimed at the sporting structure, and thus the sporting entities that can both claim and enforce these mechanisms. The third chapter approached alternative dispute resolution methods, in particular dispute resolution in classical and sports arbitration, where solidarity mechanisms are precisely enforced. The fourth chapter dealt with athletes' transitions, which are the trigger for the application of solidarity mechanisms. The fifth chapter explained in detail the conditions under which solidarity mechanisms arise, including an illustration of their calculation, in order to finally illustrate, in the subsequent chapter six, how these mechanisms are enforced in sports arbitration, depending on the level of the sporting structure.en
